Terms & Conditions

PropertyPixels.Media Client Agreement, Terms of Service & Media Licensing Policy

These Terms of Service ("Agreement") govern all services provided by PropertyPixels.Media ("PropertyPixels.Media," "we," "our," or "us"). By placing an order, scheduling services, submitting payment, accepting delivery of media, or otherwise using our services or website, you ("Client") agree to be bound by this Agreement.
 

1. Services
 

PropertyPixels.Media provides professional real estate media services, including but not limited to photography, drone photography, aerial imaging, video production, floor plans, virtual staging, virtual twilight conversions, image editing, AI-assisted enhancements, marketing materials, and related visual media.
 

These Terms apply to all current and future services unless otherwise agreed to in writing.
 

2. Scheduling & Property Access
 

Appointments are subject to availability and are confirmed upon acceptance by PropertyPixels.Media.
 

The Client is responsible for providing accurate:

  • Property address

  • Access instructions

  • Lockbox information

  • Gate codes

  • Contact information

  • Appointment details

  • Special requests
     

If the photographer cannot access the property upon arrival, additional trip or rescheduling fees may apply.
 

3. Property Readiness
 

The property must be photo-ready upon arrival.
 

PropertyPixels.Media is not responsible for cleaning, staging, decluttering, landscaping, moving furniture, removing vehicles, or preparing the property.

Minor adjustments may be made at the photographer's discretion but are not guaranteed.
 

If the property is not ready, PropertyPixels.Media may photograph the property as presented, wait (if scheduling allows), reschedule the appointment, or cancel the appointment. Additional fees may apply.
 

4. Weather & Drone Operations
 

Drone services are subject to:

  • FAA regulations

  • Airspace restrictions

  • Weather conditions

  • Safety considerations

  • Equipment limitations
     

PropertyPixels.Media reserves the right to cancel, postpone, or modify drone services whenever necessary.
 

The inability to legally or safely operate a drone does not constitute a breach of this Agreement.
 

5. Payment
 

Payment is due according to the selected payment method unless other written arrangements have been made.
 

PropertyPixels.Media reserves the right to withhold delivery of media until payment has been received.
 

Past-due invoices may be subject to collection efforts and any costs permitted by applicable law.
 

6. Delivery
 

Delivery times are estimates only.
 

PropertyPixels.Media is not responsible for delays caused by weather, equipment failure, internet outages, software providers, illness, or other events beyond our reasonable control.
 

7. Copyright Ownership
 

All photographs, videos, drone imagery, floor plans, graphics, edited images, marketing materials, and every other form of media produced by PropertyPixels.Media remain the exclusive intellectual property and copyrighted works of PropertyPixels.Media.
 

Payment for services does not transfer ownership of the copyright.
 

No ownership rights are transferred unless expressly granted through a separate written agreement signed by PropertyPixels.Media.
 

8. License to Use
 

Upon full payment, the Client receives a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property for which the media was originally created.
 

This license expires when the property is sold, withdrawn from the market, or the associated marketing campaign has concluded, unless otherwise agreed in writing.
 

9. Permitted Use
 

Clients may use the delivered media for:

  • MLS listings

  • Real estate websites

  • Social media

  • Property brochures

  • Digital advertising

  • Print advertising

  • Marketing materials directly related to the original property listing
     

10. Prohibited Use
 

Without prior written permission from PropertyPixels.Media, media may not be:

  • Sold

  • Licensed

  • Assigned

  • Shared with third parties for independent use

  • Reused for future listings

  • Used by builders

  • Used by contractors

  • Used by architects

  • Used by designers

  • Used by stagers

  • Used by Airbnb or vacation rental operators

  • Used by property management companies

  • Used for commercial advertising unrelated to the original listing

  • Used by any person or organization other than the original licensed Client
     

Separate licensing is available for these uses.
 

11. Editing, Alteration & AI Modification
 

To preserve the integrity of our work and protect our brand, clients may not edit, manipulate, alter, enhance, filter, recolor, retouch, remove watermarks, add graphics, replace skies, perform AI editing, remove objects, add objects, or otherwise modify any media created by PropertyPixels.Media.
 

The sole exception is proportional resizing or cropping for placement within MLS systems, websites, brochures, flyers, social media, or other marketing materials.

No other modification is permitted without prior written authorization from PropertyPixels.Media.
 

12. Copyright Enforcement
 

Unauthorized use of PropertyPixels.Media's copyrighted work, including but not limited to unauthorized editing, alteration, AI modification, redistribution, resale, use beyond the original license, use after license expiration, or use by third parties without written authorization, constitutes copyright infringement.
     

PropertyPixels.Media reserves all rights and remedies available under applicable copyright laws, including the right to seek:

  • Payment of appropriate licensing fees

  • Statutory damages where available

  • Injunctive relief

  • Recovery of attorney's fees and legal costs where permitted by law

  • Any other remedies available under federal or state law
     

Failure to enforce any provision of this Agreement shall not constitute a waiver of future enforcement.
 

13. Portfolio Rights
 

Unless otherwise agreed in writing, PropertyPixels.Media retains the right to display all created media in portfolios, social media, websites, advertising, competitions, educational materials, and promotional publications.
 

14. Virtual Staging & AI Content
 

Virtual staging, AI enhancements, virtual renovations, object removal, and similar edits are intended for marketing purposes only.

Clients are solely responsible for complying with MLS rules, disclosure requirements, brokerage policies, and applicable laws regarding digitally altered imagery.
 

15. Limitation of Liability
 

PropertyPixels.Media's total liability arising from any claim shall not exceed the amount paid for the affected services.
 

Under no circumstances shall PropertyPixels.Media be liable for indirect, incidental, consequential, special, or punitive damages.
 

16. Force Majeure
 

PropertyPixels.Media shall not be liable for delays or failures caused by severe weather, natural disasters, governmental action, equipment failure, illness, labor disputes, internet outages, acts of God, or any circumstance beyond reasonable control.
 

17. Indemnification
 

The Client agrees to defend, indemnify, and hold harmless PropertyPixels.Media from claims arising from unauthorized use of media, inaccurate information, lack of authority to grant access, violations of MLS rules, or misuse of delivered media.
 

18. Governing Law
 

This Agreement shall be governed by the laws of the State of North Carolina.

Any dispute arising under this Agreement shall be resolved in a court of competent jurisdiction located in North Carolina unless otherwise required by law.
 

19. Severability
 

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
 

20. Entire Agreement
 

This Agreement constitutes the complete understanding between the Client and PropertyPixels.Media regarding the services provided and supersedes all prior verbal or written agreements concerning those services.

By placing an order, scheduling services, submitting payment, accepting delivery of media, or checking the agreement box during the online ordering process, the Client acknowledges that they have read, understood, and agree to these Terms of Service and Media Licensing Policy.
